On June 21, 2018, the Supreme Court announced its decision in the South Dakota vs Wayfair case – one that granted states the right to tax out-of-state sellers for products sold within their borders. This ruling changed how businesses must tax sales to out of area clients. In the past, a business needed “nexxus” to be considered operating in that state. This meant a physical location such as a warehouse or storefront. Online sellers rarely fell into this category, so they did not need to collect tax from clients residing outside of their state. This law has changed all of the rules regarding out of state sellers.
